1 PURPOSE, SCOPE, PUBLICATION, MODIFICATION OF THE GENERAL TERMS AND CONDITIONS

1.1 Purpose of the General Terms and Conditions

The General Terms and Conditions (hereinafter referred to as: GTC) shall regulate the terms of the legal relationship established by the registration between the natural person or the organizations with legal personality represented by the natural person (hereinafter referred to as: Guest) and the natural person or company providing accommodation services (hereinafter referred to as: Host) on the platform provided by godirect.website website (hereinafter referred to as: System).

The purpose of the GTC is to define the method and conditions of the use of the booking system and the rights and obligations of the Guest and Host within their legal relationship established by accepting these GTC.

2 DEFINITIONS

  • Guest: a natural person using the system of godirect.website for the purpose of booking an accommodation
  • Local laws: laws applicable on the seat, residence of the Host or Use, or laws relevant to this legal relationship that differ from the laws effective in Hungary
  • System: websites of godirect.website, appartman.hu and appartman.io
  • Host: a natural person or company registered in the System providing accommodation services
  • Services:includes operating the System, ensuring booking of accommodation, providing accommodation services as activities for consideration that - to satisfy the needs of the Customer and the Client - involves the establishment of a result, performance of an achievement or conduct of a certain behavior.
  • Operator: Appartman PMS Technologies Korlátolt Felelősségű Társaság (Seat: H-3557 Bükkszentkereszt, Dózsa utca 2. tax number: 27441792-2-05) operating the system of godirect.website
  • Guest:a natural person or the organization with legal personality represented by the natural person who makes the reservation of the accommodation

2.1 Scope

The personal scope of the GTC shall extend to the Guest and the Host. The subjects of this legal relationship are natural persons of the minimum age of 18 years or organizations with legal personality. Persons under age of 18 years are not entitled to use the System.

The GTC shall apply for an indefinite period from the date of the front page of the document. To the use of service, the terms of GTC effective at the date of the registration shall prevail.

The modifications of the GTC shall be effective from the date of its publishing on the website godirect.website.

The effective rules of Hungary shall apply to the use of the System.

The Operator shall make the services provided available without any geographical territorial constraint. However, different GTC apply to hosts that perform their activities in Hungary and in regions other than Hungary. These GTC apply to the services provided in regions other than Hungary.

2.2 Alkalmazandó jog

The effective legal rules of Hungary and the European Union shall apply to the use of the System. The Hungarian regulation is in accordance with the regulations of the relevant EU legislation.

2.3 Felelősség

Guest hereby accepts that the Host is responsible for the natural and legal persons as users of the System to correspond with the regional legally binding legal regulation (e.g. consumer protection rules). The activities necessary for corresponding with the regional rules are performed by the Host via their own devices (e.g., website, email, and other communication devices). That is not provided support by the System. Guest hereby acknowledges that the Host shall bear the responsibility for the performance of the obligations required by the regional regulation thus, the Host is not entitled to claim any indemnification against the Operator.

The Guest hereby accepts that the Operator excludes responsibility in accordance with the law, for every direct or indirect loss and damage in connection with the use of the System, for the inaccurate information relevant to the Host or the performance of the accommodation service. The Operator also excludes every responsibility concerning damage and other indemnification, should the Host breach the conditions of these GTC.

2.4 Publication

The Operator shall publish the GTC, the Annexes and the previous versions in electronic format, and by enabling the option of searching in the texts and distinguishing between the effective versions of 5 years prior.

3 PERSONS SUBJECT TO GTC

The name, seat, post address, telephone number, e-mail address, website of the Host are available on the electronic platform ensured by the System.

The contact information of the Guest shall be submitted on the form for booking.

4 MOST IMPORTANT CHARACTERISTICS OF SERVICE

The main characteristics and services of the accommodations are displayed by the System. The reservation calendar helps in verifying whether an accommodation with the required parameters in the required period is available for booking.

The booking platform provides assistance with booking the accommodation, the reservation will be confirmed via e-mail to the Host and the person booking the accommodation.

Cancellation of booking is authorized when complying with the cancellation terms published by the Host.

5 SYSTEM REQUIREMENTS, TERMS FOR USE OF THE SYSTEM, AVAILABILITY

Supported browsers:

  • Latest version of Google Chrome,
  • Latest version of Firefox,
  • Latest version of Opera,
  • Latest version of Microsoft EDGE.

Other conditions

  • Web browser with SSL authentication.
  • Permission to run Java script.
  • Setting up a web browser security at the „medium security level” is recommended. Applying the high security level and certain supplements might block the scripts from running.
  • Recommended screen resolution: 1280 * 720 pixel.
  • Attachment size limit per file:
  • picture: 2 MB,
  • other file: 25 MB.

5.1 Availability of the System

The availability of the System is 90 %. The normal maintenance is usually at night (between 10 pm and 6 am).The system notice on the date and duration of the normal maintenance shall be published on the Operator’s website. The information on the malfunction of the System is also published on the Operator’s website. The duration of the normal maintenance is not included in the period of guaranteed availability. The service may be temporarily unavailable in case of force majeure. In this case, the Operator shall subsequently inform the Host. The Operator does not provide constant access to the System, thus excludes the responsibility related, and the Host may establish no such claims against the Operator.

5.2 Quality, security of the System

Within the data security concerning the processing of personal data, the data processed are only accessible to the ones entitled and the data are unaltered and protected against any unlawful access. The Host is responsible for providing correct data that are necessary to the use of the System and uploaded in there.

6 GENERAL INTRODUCTION OF THE SYSTEM/SERVICE

The System provides the following services, via internet:

  • uploading and display of the data of accommodation (text and picture),
  • display of time availability of the accommodation on the calendar platform,
  • option of booking parameters (arriving persons, rooms, services)
  • booking the accommodation at the price and parameters indicated.

Request for accommodation service, booking, modification and cancellation are submitted on the Internet website.

7 RIGHTS AND OBLIGATIONS OF THE PARTIES

After having selected the accommodation and the parameters required, the button „Submit the request for booking” shall be clicked upon. The confirmation e-mail establishes the agreement between the parties on use of accommodation services.

7.1 Rights and obligations of the Guest

The Guest is entitled to use the System in accordance with the GTC and the relevant laws, including

a) to acquire information published in the System,

b) to book the accommodation selected,

c) to use the accommodation with the parameters defined in the reservation,

d) to cancel the reservation complying with the cancellation policy published on the site of the accommodation.

The Guest is obliged to:

a) pay the fee of the accommodation,

b) to comply with the accommodation policy regulating the use of the accommodation,

c) to guarantee the accuracy and up to date status of the data uploaded in the System,

d) to use the services applied for solely lawful purposes and in accordance with the law,

e) to refrain from misusing the name, e-mail address or other personal data of other persons, and from collecting information regarding other persons,

f) immediately indicate any technical problems, operational malfunctions during the use of the system.

The Guest is responsible for the consequences of omitting and infringing upon the obligations mentioned above.

7.2 The rights and obligations of the Host

The Host is entitled to:

a) charge the fee as consideration of the accommodation service published ont he site of the accommodation in the System.

The Host is obliged to:

a) ensure the accommodation service with the parameters indicated in the System.

7.3 Proper use

Without the written permission of the Operator of the Host, it is forbidden to observe, copy, map, download, reproduce or use the data in the System for business purposes.

The Operator is entitled to disable every user who is assumably:

  • performs numerous unjustified searches,
  • uses any device or software to collect prices or any other information,
  • proceeds so that they System is encumbered to an unjustified extent.

7.4 Liability of compliance with GTC

Complying with the rules of GTC does not exempt the Parties from complying with the relevant legal rules. Should there be any discrepancies between the GTC and any other legal rules, the legal rules shall apply. Should the GTC not regulate a specific matter, the relevant legal rules shall apply.

8 FORCE MAJEURE

Should the Parties - because of a force majeure event – be hindered to perform their duties established in these GTC and consequently they cause damage, the party hindered is exempted from the consequences of the performance of the obligation to an amount in which the party was hindered in his performing of duties by the force majeure event. Parties shall inform each other on the force majeure event hindering the performance of the service. Parties shall cooperate to a reasonable extent in order to restore the adequate performance and the mitigation of the consequences of the force majeure event.
